These Terms of Service (“Terms”) govern your access to and use of the digital platform provided by TopScaling (“we,” “us,” or “our”). By using the platform, you agree to these Terms.


1. Platform Access

TopScaling provides access to an AI-driven automation platform designed for HVAC businesses to handle inbound calls, qualify leads, and schedule service appointments through automated workflows.

The platform may include:

AI-based call handling and appointment scheduling logic

Lead qualification and routing workflows

CRM and calendar integrations

System usage analytics

The product is sold as platform access and automated system usage.
Advertising services, ad management, marketing campaigns, or consulting services are
not included unless explicitly agreed in a separate written agreement.

TopScaling does not provide HVAC repair, installation, or field services.


2. No Guarantee of Business Results

The platform is intended to assist with call handling and scheduling efficiency only.
We do not guarantee revenue, profit, job completion, or business outcomes unless explicitly stated in a written agreement.

Results depend on factors outside our control, including pricing, service quality, staffing, availability, and local market conditions.


3. Client Responsibilities

You agree to:

Provide accurate business and configuration information

Comply with all applicable laws, including call recording, TCPA, and SMS consent requirements

Ensure proper follow-up and service delivery for booked appointments

Maintain sufficient staffing to handle scheduled jobs


4. AI System Limitations

You acknowledge that:

AI systems operate based on predefined rules, scripts, and data

Automated systems may occasionally misinterpret inputs

The platform is not a substitute for human judgment or licensed professionals


5. Fees & Billing

Access to the platform is provided in exchange for a platform service fee, billed according to the agreed subscription terms.

Third-party costs (including call minutes, SMS usage, or external integrations) may be billed separately if applicable.

Failure to pay may result in suspension or termination of platform access.


6. Cancellation & Termination

Either party may terminate access according to the agreed subscription or service terms.

Upon termination:

Platform access may be revoked

Data may be deleted after a reasonable retention period unless legally required


7. Intellectual Property

All software, workflows, automation logic, and systems remain the intellectual property of TopScaling.

You are granted a limited, non-transferable license to use the platform during an active subscription period.


8. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect, incidental, or consequential damages

Total liability shall not exceed the fees paid in the previous 30 days


9. Indemnification

You agree to indemnify and hold harmless TopScaling from claims arising from:

Misuse of the platform

Violation of applicable laws

Improper handling of customer data or consent


10. Governing Law

These Terms are governed by the laws of England and Wales.


11. Updates

We may update these Terms from time to time. Continued use of the platform constitutes acceptance of the updated Terms.
